The case was continued on June 2 against the man at the center of a use-of-force arrest by three officers with the Asheville Police Department.
Devon Whitmire was due in court on numerous charges, including communicating threats, assault and resisting a public officer. His next court date was set for June 12.
Also, “the latest developments in the aftermath of Devon Whitmire’s arrest came at a June 2 Buncombe County District Court hearing in which a judge denied a request by Whitmire’s attorney to reduce his $85,000 bond,†the Asheville Citizen Times reported later June 2. “Chief District Court Judge Calvin Hill also denied a prosecutor’s request at the hearing to raise the bond.
What’s more, the ACT noted, “Whitmire, 27, appeared in court but did not speak, standing behind a secured area with bars. He remains in the county detention facility charged with multiple counts of assault, including assault on a government official inflicting serious injury. Prosecutors say they will ask a grand jury to indict him, something that could happen by June 9, moving his case to Superior Court.â€
On May 13, Asheville police arrested Whitmire, who was wanted on an outstanding warrant for making violent threats against his family members. Whitmire’s fiancé Carrie Spiegle recorded a video of the police take-down as Whitmire struggled against officers.
Her video was posted to social media and quickly raised questions about the appropriateness of the officer’s conduct during the arrest.
Police Chief David Zack and Buncombe County District Attorney Todd Williams have said the officers’ actions during the arrest were justified.
