Firing overturned; Byrd might get his APD job back

A police captain who was fired has the right to get his job back, Asheville’s Civil Service Board has ruled, Asheville television station WLOS News 13 reported on July 30.

Mark Byrd, an officer with nearly 20 years on the force, was dismissed about a year ago.

Byrd, an outspoken critic of Asheville Police Department leadership, faced demotions and re-assignments before being promoted to captain prior to Tammy Hooper’s stint as chief.

Hooper, who left her position as police chief at the beginning of January, accused Byrd of lying and ethics violations in justifying his termination.

But now, Byrd appears to have been vindicated, based on a 4-1 Civil Service Board vote declaring Hooper was not justified in firing him.

“Our ruling as a Civil Service Board has basically rescinded his firing,” board chair Carol Goins told WLOS on July 30. “So, while I guess there will be some procedural paperwork, he will be allowed to resume his duties.”

Following the vote, which came after three days of testimony, a spokesman for the city of Asheville said there was no comment until the board finalizes its decision in a written report.
